Privacy statement

The responsible handling of personal data is very important to us. The counselling network for victims of racism, c/o humanrights.ch, meets the requirements of those that came into force on May 25, 2018 EU Data Protection Regulation (GDPR) and complies with the Federal Data Protection Act (DSG) of September 25, 2020. In accordance with Articles 19 and 20 of the Federal Act on Data Protection (DSG) of September 25, 2020, data subjects and potentially affected persons are informed about the processing of personal data (including the procurement of personal data) by humanrights.ch.

No consent to the privacy policy is required from data subjects and potentially affected persons, i.e. from those seeking advice, their relatives or other contact persons, from persons who make inquiries, or from users of the network-racism.ch website. The privacy policy is only one-sided information about the type, scope and purpose of the use of personal data.

We reserve the right to unilaterally change the content of this privacy policy at any time and without notice. It is therefore recommended that you regularly consult the privacy policy on the website.

Processing of personal data from people seeking advice

We process personal data (data that directly or indirectly identify natural persons), which we receive or collect ourselves as part of assignments in the consulting sector from people seeking advice or involved third parties.

Data subjects provide us with some of this personal data themselves when they contact us by e-mail or by telephone and post and request services. This includes, for example, name and contact details. We also process personal data that you receive in correspondence with third parties (in particular relatives, authorities, courts, legal representatives and other advice centers) as part of our consulting activities. We also collect some personal data ourselves, e.g. from public registers or on websites.

We process the mentioned types of personal data primarily to provide services (e.g. advice) and to document systematic violations of fundamental rights.

In order to achieve the purposes described in this privacy policy, it may be necessary for us to share personal data with the following categories of recipients: authorities, legal agencies, universities.

All data from those seeking advice is stored on a double-encrypted database.

We only store (store, archive) personal data for as long as is necessary to process the consulting relationship, as long as there is a legal storage and documentation obligation, or we have an overriding private or public interest in doing so (e.g. defending against liability claims up to the absolute statute of limitations).

If people seeking advice provide us with personal data about a third party (e.g. their relatives or other contact persons), it is up to the person seeking advice to inform them in general about the processing by us.

Processing of personal data

In general

In order for our offers to be targeted, relevant and to be used efficiently, it is necessary to collect certain data. People who are interested in the continuing education platform and sign up with an offer, subscribe to a newsletter, report a case or financially support the advice network for victims of racism provide us with personal data. These are compared with the existing address master files and stored electronically. They are used exclusively for the purposes of the Counseling Network for Victims of Racism. In order to maintain contact, it may be necessary to pass on extracts of this data to a service provider commissioned by us (e.g. a counseling center). They are subject to data protection law and may neither use nor share the data in any other way in accordance with the agreement. Apart from that, we do not give or market any personal data to third parties.

email traffic

E-mail is not a secure means of communication; e-mail traffic does not meet the requirements for communication of particularly sensitive personal data or communication under professional secrecy. Anyone who communicates with us via e-mail does so at their own risk.

We assume that persons who communicate via e-mail traffic agree to this type of communication and thus consent to the use of e-mail by us or one of our advice centers to answer inquiries.

newsletters

Anyone who provides us with an email address can receive information (such as payment confirmations, training or event information) via email. However, information, in particular newsletters, will only be sent regularly with the additional consent of the interested person (opt-in). If you no longer wish to receive our newsletter, you can unsubscribe quickly and easily via the unsubscribe link contained in the newsletter.

To send email newsletters, we use SendGrid, a platform for transactional and marketing emails based in the USA, among others, which enables evaluations to optimize our communication. The use of our newsletter (openings, clicks on links) is saved and linked to personal data. This enables us to improve our offerings.

The servers on which SendGrid processes the data are located in the USA, among others, i.e. your email address is transmitted to the appropriate servers. SendGrid's related privacy policy can here be read up.

When you visit the network-racism.ch website, the web server registers impersonal usage data by default. This data provides information about pages and files accessed, the IP address of the requesting computer, time and duration of the visit, operating system and browser type. We used web analysis tools for recording and evaluation Google Analytics.

Cookies are used on network-racism.ch. These are small text files that are stored on the devices used when accessed in order to evaluate impersonal usage data or to recognize recurring visits (e.g. language selection, visits to certain pages). humanrights.ch uses both session cookies, which expire after the session has ended, and permanent cookies, which only expire after a certain period of time or when deleted manually. In general, cookies can be deleted and deactivated in the browser settings at any time.

Network-racism.ch also informs all first-time visitors to the website about their use with a cookie banner.

We have no influence on external content to which we link, nor on compliance with data protection regulations by third parties whose functions are integrated on our websites. In this regard, we would like to draw your attention in particular to the privacy policies of the following third-party providers: Instagram Inc.

webpage hosting provider

We host our website with Webflow. The provider is Webflow, Inc., 398 11th Street, 2nd Floor, San Francisco, CA 94103, USA (hereinafter: Webflow). With every visit to our website, Webflow automatically collects and stores information (server log files) that your browser transmits. This includes the name and URL of the retrieved file, date and time of access, amount of data, web browser and web browser version, operating system, the domain name of your Internet provider, the so-called referrer URL (the page from which you accessed our offer) and the IP address.

Webflow is a tool for building and hosting websites. Webflow stores cookies or other recognition technologies that are necessary to display the page, to provide certain website functions and to ensure security (necessary cookies).

The above data is processed by us for the following purposes:

  • ensuring a smooth connection to the website,
  • ensuring convenient use and reliable presentation of our website,
  • evaluation of system security and stability, and
  • for further administrative purposes and in the event of illegal use of our website or services.
  • Within the scope of application of the GDPR, this data is processed on the basis of our legitimate interest (Article 6 (1) (f) GDPR) in accordance with the purposes listed above.

payments

We treat payment data of all types extremely confidentially. humanrights.ch keeps its accounts in accordance with FER-21 and thus guarantees transparent accounting; in particular, the use of earmarked and unrelated funds is reported separately. The credit card data entrusted to humanrights.ch is encrypted to an external partner certified by the credit card industry (PCI DSS) (Payrexx) transmitted. They are not stored or evaluated by us ourselves.

Rights of data subjects

In particular, data subjects have the right to access the personal data processed about them and the purpose of data processing (Art. 25 DSG), the right to correct and delete or restrict the processing of their personal data (Art. 32 DSG), the right to object to processing, the right to seek an appeal with a competent supervisory authority (Federal Data Protection Act). Information and Data Protection Officer, FDPÖB) and on the release or transfer of the personal data provided by it (Art. 28 and 29 DSG). It should be noted that there are prerequisites and exceptions for these rights. To the extent permitted or required by law, we may deny requests to exercise these rights. In addition, personal data may have to continue to be stored or processed for legal reasons despite requests to delete or restrict processing.

In the case of requests relating to the exercise of rights by the data subject, the principles of processing personal data from clients (see section 2 above) apply to the processing of personal data.
